Please read these terms carefully. They explain your rights and responsibilities when you use The Card Project.
1. About these terms
These Terms & Conditions ("Terms") form an agreement between you and [PLACEHOLDER: company / legal name], registration no. [PLACEHOLDER: SSM registration number], of [PLACEHOLDER: registered business address] ("The Card Project", "we", "us").
By creating an account, activating a card or using this website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. The Service
The Card Project provides physical business cards with an NFC chip and a QR code, an online profile page that the card opens, and a dashboard to manage your profile and card (together, the "Service").
How we handle changes to the Service is set out in "Changes to the service" below.
3. Your account
You must be at least 18 years old and able to enter into a binding contract.
Give accurate information and keep your email address up to date.
Keep your password secret. You are responsible for activity under your account; tell us promptly if you suspect unauthorised access.
One person per account. Accounts may not be sold or transferred without our consent.
4. Acceptable use
You agree not to use the Service to:
impersonate another person or business, or publish details that are not yours to share;
publish unlawful, misleading, defamatory, obscene, hateful or infringing content;
link to malware, phishing, scams or other harmful sites;
send spam or collect other people's data without their consent;
interfere with the Service, probe it for vulnerabilities without permission, or access it by automated means beyond normal browsing;
break any law of Malaysia, including the Communications and Multimedia Act 1998.
5. Your content
You own the information and photos you add to your profile ("Your Content") and are responsible for it, including that it is accurate and that you have the right to publish it.
You give us a non-exclusive, royalty-free licence to host, store, display and format Your Content as needed to run the Service (for example, showing your profile and generating a contact file). This licence ends when you delete the content or your account.
Your profile is public: anyone with your card or link can view and save it. We may remove content or suspend a profile that breaks these Terms or the law.
6. Cards, NFC and QR codes
Each card has a unique ID. Its NFC chip and QR code contain only a link to our website, never your personal details. Tapping or scanning the card opens your current profile.
A card works once you activate it with your account. Until then, it shows a "card not registered" page.
NFC tapping needs a compatible phone with NFC turned on; some phones need to be unlocked or held in a particular spot. The QR code works with any phone camera. We cannot guarantee every device can read the card.
Your card's QR code may be set to open your profile or another web address you request. We may refuse addresses that break these Terms.
Card designs shown on the website are representative; small differences in colour and finish may occur in print.
Do not bend, cut, puncture or expose the card to strong heat or magnets; this can damage the chip.
7. Membership and renewal
THE CARD 001 costs RM79 and includes the first 12 months of membership, counted from the day you activate the card. After that, membership renews at RM29 per year. There is no monthly subscription. Prices are shown on our website and confirmed before you pay.
While your membership is active you can edit your profile at any time, and changes appear immediately on cards already handed out.
If your membership expires, your public profile stays live for a 30-day grace period. Editing is locked from the expiry date until you renew.
After the grace period, your public profile is paused until you renew: your card, QR code and profile link show a paused page instead of your details. Nothing is deleted.
Renewing restores the same card, profile and link.
Memberships that started before the commercial launch of THE CARD 001 ([PLACEHOLDER: commercial launch date]) keep their existing terms: if such a membership expires, the profile stays visible and the card keeps working, but editing is locked until it is renewed.
Membership does not renew automatically. You can renew from the Membership page in your account.
Fees paid are non-refundable except where required by law, including your rights under the Consumer Protection Act 1999, or where we cannot provide the Service.
8. Suspension and termination
You may stop using the Service and ask us to delete your account at any time by contacting us. Once deleted, your profile goes offline and your card no longer shows it.
We may suspend or close your account, with notice where reasonable, if you seriously or repeatedly break these Terms, if required by law, or to protect other users or the Service. Fees already paid for a period in which you broke these Terms are not refunded.
9. Disclaimers
We work to keep the Service available and secure, but it is provided “as is” and “as available”. We do not guarantee it will be uninterrupted or error-free, and planned maintenance or problems with third-party providers may cause downtime. We are not responsible for content that users publish or for third-party websites linked from profiles.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, such as lost business, profits, opportunities or data. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer in Malaysia.
11. Changes to the service
We keep improving The Card Project, so features, designs and page layouts may be added, changed or removed. We make these changes so that your card's link and printed QR code keep working.
If we plan to remove something you rely on, or to stop the Service, we will tell active members by email or in the dashboard with reasonable notice before it happens.
12. Changes to these terms
We may update these Terms. We will change the effective date above and give notice of significant changes by email or on your dashboard. If you keep using the Service after changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Malaysia. Any dispute will be handled by the courts of Malaysia, and we encourage you to contact us first so we can try to resolve it informally.
